USCIS will extend the suspension of premium processing for H-1B petitions

The USCIS is extending the temporary suspension of premium processing for H-1B petitions. It is expected that this suspension will last until Feb. 19, 2019. While H-1B premium processing is suspended, USCIS will reject any Form I-907 submitted for non-immigrant workers. The temporary suspension affects almost all H-1B visa petitions filed at the Vermont and California Service Centers.

According to USCIS, this temporary suspension will help to reduce the overall H-1B processing times by allowing the agency to process long-pending petitions, which have been unable to be processed due to the high volume of incoming petitions and premium processing requests over the past few months.  This will also provide USCIS additional time to appropriately prioritize adjudication of H-1B extension of status cases that are nearing the 240-day mark.

Although premium processing is suspended, petitioners may submit a request to expedite an H-1B petition if the petitioners can demonstrate that they meet at least one of the expedite criteria. In this case petitioners should be prepared to submit documentary evidence to support their expedite request.

This temporary suspension of premium processing does not apply to any other nonimmigrant visa classifications for workers, which requires a Form I-129.
